Unlicensed Mental Health Practitioners Requirements

License Requirements:
The Office of Mental Health Practice (OMHP) was established for consumers receiving mental health services from practitioners who fall outside of the licensing authorities for Minnesota psychologists, social workers, marriage and family therapists, and psychiatrists (physicians), nurses, licensed professional counselors, and alcohol and drug counselors. OMHP requires unlicensed mental health practitioners to follow certain rules of conduct, and to provide their clients with the Mental Health Client Bill of Rights. Consumers receiving mental health services, or any concerned individual, may file a complaint about an unlicensed mental health practitioner with the OMHP, or receive information from the OMHP about state regulations governing both licensed and unlicensed mental health practitioners.
OMHP receives and investigates complaints against mental health practitioners who are not licensed in the state of Minnesota, and can take and enforce disciplinary action against unlicensed mental health practitioners for violations of an ethical code of conduct.
Under the current law in Minnesota, unlicensed mental health practitioners do not need to register or file their credentials with the state. **However, state law mandates that unlicensed mental health practitioners provide their clients with a written Mental Health Client Bill of Rights".**
Mental Health practitioners who may practice in Minnesota without a license include (but are not limited to):
* psychotherapists
* hypnotherapists
* private school counselors
* spiritual counselors
* therapists
An individual must have a license in Minnesota if they are practicing as a:
* psychologist
* professional counselors
* social worker
* marriage and family therapist
* psychiatrist (physician)
* nurse
* alcohol and drug counselor
